CENTRAL EXCISE CESTAT Cases

Central Excise – Eligibility of sewage pumps and drainage pumps to concessional rate of duty under Sr. No. 235 of Notification No. 12/2012-CE - Appellant manufactured power driven pumps and, from April 2016, availed the concessional rate of duty on sewage pumps and drainage pumps, after paying duty at the full rate earlier, and the Respondent denied the benefit and demanded differential duty with interest - Whether sewage pumps and drainage pumps are power driven pumps primarily designed for handling water within the entry - HELD - An exemption notification is to be interpreted strictly and the burden of proving that the goods fall within its four corners is on the assessee. Words of a fiscal statute not defined therein are to be understood in the sense in which they are understood in the trade and in common parlance. The term water is not defined in the Central Excise Tariff and, as per dictionary meaning and common parlance, refers to clean water and not to sewage or drainage water. The Appellant itself, in reply to the audit objection, contended that the design and manufacturing process of pumps for handling water differ from pumps for sludge or muddy sewage water. The certificate of the Chartered Engineer only states that the pumps can also be used for clean water and does not comment on the similarity of design. The decision relied upon by the Appellant is distinguishable as the notification covers pumps primarily designed for handling water - The benefit of the entry is available only to power driven pumps primarily designed for handling clean water, the Appellant is not entitled to the concessional rate on sewage pumps and drainage pumps, and the differential duty with interest is upheld - Central Excise – Plea of res judicata and change of departmental stand on the basis of audit objection - Appellant contended that the Respondent, having accepted through the audit memo that concessional duty was inadmissible and later that it was payable, could not take a different stand and demand full duty - Whether the Respondent is barred from taking a different stand on the rate of duty applicable to the pumps - HELD - Res judicata does not apply to tax matters for different periods as the cause of action for each period is distinct. The Appellant contested the audit para at that time, and the audit observation was neither pursued by the Respondent nor implemented by the Appellant, and no show cause notice was issued. A decision not followed by either side cannot be pleaded for implementation on the ground of res judicata. The Respondent is not barred from taking a different stand where there is just cause or public interest - The plea is devoid of merit and is rejected - Central Excise – Penalty under Rule 25(1) of the Central Excise Rules, 2002 read with Section 11AC(1)(a) - Appellant initially paid duty at the full rate, started claiming the concessional rate after the audit objection, and the Respondent then demanded differential duty, and the Commissioner (Appeals) imposed penalty at a percentage of the duty - Whether penalty is imposable on the Appellant - HELD - The Appellant was initially paying the full rate of duty and began claiming the concessional rate subsequent to the objection raised by the Audit, after which the Respondent took a U-turn and demanded differential duty. There is no evidence against the Appellant which could warrant imposition of penalty - The penalty is set aside, the impugned order is upheld with this modification, and the appeal is partly allowed.
